OFFICIAL CONTEST RULES

 

1.    CONTEST PERIOD:

The Work It Day To Night with TRESemmé contest (the “Contest”) will take place starting  from 10:00:00 a.m. EST on October 9, 2017, to 11:59:00 p.m. EST on November 30, 2017 (the “Contest Period”).  At the beginning of the Contest Period, there will be a total of five (5) Prizes available for all Eligible entrants who visit our contest portal and share your best day-to-night hair tip. Consumers will be able to visit our contest daytonightcontest.tresemme.ca for a chance to enter to win.

 

2.    ELIGIBILITY:


To be eligible to enter the Contest and win a Prize (as defined below), an individual must be (i) a Canadian legal resident; and (ii) have reached the legal age of majority in his/her province or territory of residence. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Unilever Canada Inc.  (“Sponsor”), its parent company(ies), subsidiaries, affiliates, distributors, suppliers, advertising/promotion agencies and any other individual or entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”) are not eligible to enter or win.

 

3.    HOW TO ENTER:

There is no limit on the number of entries per person during the Contest Period but each entry must contain a unique Tip. The Sponsor and its designated representative reserves the right, in its/his/her sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor or its designated representative – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the complete satisfaction of the Sponsor or its designated representative within the timeframe specified by the Sponsor or its designated representative may result in disqualification of the applicable participant (as determined by the Sponsor’s or its designated representative at its/his/her sole and absolute discretion) and, if disqualified, any Entry provided to such participant will be considered null and void.

By participating in this Contest, you agree to be legally bound by the terms and conditions of these Rules and agree that your Tip complies with the Tip Requirements set out below:
 


TIP REQUIREMENTS:


Your submitted Tip must never have been previously published, exhibited publicly or selected as a winner in any other contest.  All Tips submitted become the property of the Sponsor.

 

By participating in the Contest the entrant agrees: (i) to be bound by these Official Rules and by the interpretation of these Official Rules by the Sponsor; (ii) that the Tip is original to him/her and that the entrant has all necessary rights in and to the Tip to enter the Tip in this Contest; (iii) that the Tip does not and will not violate any law, statute, ordinance or regulation; (iv) that the Tip will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and interests of any third party, or give rise to any claims for payment whatsoever; (v) to release and hold harmless the Sponsor and its advertising and promotion agencies, and each of their respective agents, employees, directors, successors, and assigns, against any and all claims, injury or damage arising out of or in relating to participation in the Contest, and further against any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action; (vi) that the Tip is not and will not be defamatory, trade libelous, pornographic or obscene, and further that it will not contain, include or discuss or involve, without limitation, any of the following:

 

• Obscenities;

• Nudity;

• Explicit, graphic or excessive sexual activity;

• Crude, vulgar or offensive language and/or symbols;

• Derogatory characterizations of any ethnic, racial, sexual or religious groups;

• Content which endorses, condones or discusses any illegal or inappropriate activity, behaviour or conduct

• Personal information of individuals, including without limitation, names, addresses (physical or e-mail), phone and fax numbers, license plates;

• Conduct or other activities in violation of these Official Rules;

• Commercial messages, comparisons or solicitations for products or services (other than those the Sponsor);

• Any commercial products (other than those of the Sponsor) and/or their trade-marks, brands, logos or endorsements;

• URLs or links to any websites; and

• Any other content that is or could be considered inappropriate, unsuitable or offensive, as determined by the Sponsor in its sole discretion.


The Sponsor reserves the right to remove from the website and disqualify from the Contest any Tip that that it deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Official Rules.  Sponsor also reserves the right to modify or edit, in its sole and absolute discretion, any Tip entered in the Contest, or to request an entrant to modify or edit his or her Tip in order to comply with these Official Rules or for any other reason.  Tips not complying with these contest rules will be disqualified.

 

4.    THE PRIZES AND ODDS:


Each Eligible Entry will be submitted through the contest platform and will enter the participant into the random draw conducted on November 13th, at [12:00] p.m. ET in [Toronto, Ontario] to win one (1) of the five (5) Prizes. The following table lists the details regarding the prizes (“Prize”) available to be won at the end of the Contest Period, subject to the winner confirmation procedure outlined below (see Rule 5).

The number of Prizes available to be won will remain the same throughout the duration of the contest. The Prizes must be accepted as awarded and are not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize, or a component thereof, with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. All characteristics and features of a Prize, except as otherwise explicitly described above, are at the Sponsor’s sole and absolute discretion. Any cost or expense not explicitly described above as part of the applicable Prize including, without limitation, optional activities and meals and items of a personal nature is the applicable winner’s sole responsibility. Limit of one (1) Prize per person.

 


5.    WINNER VERIFICATION/CONFIRMATION:  


BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties, prize suppliers, and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If the selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received in accordance with these Rules during the Contest Period (in which case the foregoing provisions of this section shall apply to such newly selected entrant).

 


6.    GENERAL CONDITIONS:


All Entries are the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor (or its designated representative) with respect to all aspects of this Contest are final and binding on all participants without right of appeal. The Releasees will not be liable for the failure of any individual to be eligible to Enter to Win.

The Sponsor reserves the right, at its sole and absolute discretion, subject to the approval of the Régie des alcools, des courses et des jeux (“RACJ”), to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, at its sole and absolute discretion, subject to the approval of the RACJ, to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

By participating in this Contest, each participant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: http://www.unileverprivacypolicy.com/en_ca/policy.aspx). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

The Sponsor reserves the right, at its sole and absolute discretion, and without notice, subject to the approval of the RACJ, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any participant or Entry with these Rules, or as a result of technical problems, or in light of any other circumstances that, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any other materials, including, but not limited to the Entry, the French contest rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.

If due to printing, production, online, Internet, computer or other error of any kind, more Prizes are claimed than intended to be awarded according to these Rules (at any prizing level), or in the event that due to such error, a valid prize claim is revealed, making the number of valid Prize claims greater than the number of Prizes available under these Rules (at any prizing level), a random draw will be held after the Contest closes from amongst all eligible Prize claimants to award the remaining number Prizes (as determined by the Sponsor at its sole and absolute discretion on the basis of its official records).  In no event will the Sponsor be liable for more than the stated number of Prizes in these Rules (at any prizing level).

FOR QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
